Complain about products and services

We can all understand the need and right to complain about products and services that do not meet our personal satisfaction standards. But, lately, I've noticed that even though we as humans tend to complain much faster than we praise, complaints have escalated dramatically.

I've thought a lot about why this is happening and came up with a lot of reasons, but the primary ones appear to me to be one, the ease and speed with which we can now complain online; two, the many venues in which to place them online, and three, the increase in consumers' concern with saving, not wasting, resources. Responsible spending is a good thing and a result of the not-so-good economic stress we've all felt in one way or another, but perhaps sometimes we might be a little too quick to complain these days.

Our franchise system like many others only offers our franchises to qualified franchise buyers. We do not offer our franchise to just anyone who has the money and surely not to anyone who does not. Just like an employer must screen applicants, so must a franchisor. And while I am at it, may I ask the FTC what a consumer who cannot balance their check book and doesn't even read their credit card statements for accuracy is going to do with a UFOC and it's attachments, for a franchise they are not even sure if they are interested in yet? Are they going to read it? All of it? And if they think they may possibly be interested in 10 different franchises are they going to read all ten? Are they going to read five, two, one? Probably none. This proposed rule helps, neither the consumer, purported consumer, the franchisor or it's current franchisees. And it will add inbound complaints to the FTC, which I will later discuss.

According to Montana Attorney General Steve Bullock, "Attorneys general throughout our nation vigorously enforce the laws designed to protect consumers. When consumers have been deceived or treated unfairly by a business, they should contact the attorney general's office in their state. By filing a complaint with our offices, our staff can work with both consumers and businesses to try to rectify the problem."

If you believe you have been the victim of a fraud or scam, you should plan to file a complaint with the Attorney General's office in your state (click here for a list of offices in your state.) Consumers who report unauthorized charges on their credit cards, fraudulent debt reduction services or other financial schemes may not see an immediate resolution to their individual complaint, but may help the Attorney General build a case against scam artists or long running bad practices by businesses. For advice on how to recoup your lost money, you might consider consulting with a consumer law attorney.

It is the responsibility of the State Attorneys General to lead enforcement for their state's consumer protection laws, making them a leader in the consumer protection force in the nation. Every state in the US has consumer protection statues prohibiting deceptive practices and acts, even if those acts occur on-line. The Attorneys General may take action against individuals or businesses who commit fraud, including areas like debt collection, telemarketing, auto sales, and misleading advertising.
